If you reside in the United States and were notified by Cadence Bank that your personally identifying information (“PII”) was included in files affected by the MOVEit data security incident (the “MOVEit Data Breach”) whereby between May 27, 2023, and May 31, 2023, cybercriminals gained unauthorized access to the MOVEit transfer application, you may be a member of the Settlement Class and eligible for benefits.
If you are a Settlement Class Member and wish to receive Settlement Benefits then you must submit a claim form by June 4, 2026.
Settlement Class Members may file a claim to receive Credit Monitoring and Identity Theft Protection Services and either: (1) reimbursement of ordinary losses up to $2,500.00 and/or reimbursement of extraordinary losses up to $10,000.00; or (2) an alternative cash payment of $100.00 (subject to pro rata reduction or increase pending total claim submission). These benefits are described more in detail below.
Credit Monitoring and Identity Theft Protection Services: Settlement Class Members may file a claim to receive two (2) years of three-bureau credit monitoring and identity theft protection services that will include:
dark web monitoring with user notification if potentially unauthorized use of a Settlement Class Member’s personally identifiable information is detected;
identity theft insurance of up to $1 million United States Dollars;
real-time credit monitoring with Equifax, Experian, and TransUnion;
access to fraud resolution and identity theft restoration agents.
Compensation for Lost Time: Members of the Settlement Class who have spent time dealing with the MOVEit Data Breach may claim up to four (4) hours for lost time at a rate of $25.00 per hour (up to $100.00 total). This payment counts toward the $2,500.00 cap for Ordinary Losses (as described below).
Compensation for Ordinary Losses: Settlement Class Members may file a claim for reimbursement of unreimbursed losses up to $2,500.00 (combined with any claim for Lost time as described above) incurred as a result of the MOVEit Data Breach. Such ordinary losses must have occurred between May 31, 2023, and June 4, 2026 and include:
out-of-pocket expenses including bank fees, long distance phone calls, cell phone charges (only if charged by the minute), data charges (only if based on the amount of data used), postage, or gasoline for local travel; and
fees for credit reports, credit monitoring, or other identity theft insurance product purchased between May 31, 2023, and and June 4, 2026;
Compensation for Extraordinary Losses: Settlement Class Members may file a claim for reimbursement of up to $10,000.00 in compensation for proven monetary losses such as losses relating to fraud or identity theft, professional fees (including attorneys’ fees and accountants’ fees), and fees for credit repair services, incurred between May 31, 2023 and June 4, 2026. In order to receive reimbursement of Extraordinary Losses, the loss must:
be an actual, documented, and unreimbursed monetary loss;
have been more likely than not caused by the MOVEit Data Breach;
have occurred between May 31, 2023, and June 4, 2026; and
not be covered by one or more of the Reimbursement for Ordinary Losses categories (as described above).
Compensation for the above claimed losses (both Ordinary and Extraordinary) other than Lost Time must be supported by reasonable documentation, which cannot be “self-prepared.” Self-prepared documents, such as handwritten receipts, are, by themselves, insufficient to receive reimbursement.
Alternative Cash Payment: Instead of filing claims for reimbursement of Lost Time, Ordinary Losses, or Extraordinary Losses, Settlement Class Members may elect to file a claim to receive a $100.00 cash payment, subject to the potential pro rata reduction or increase.

The deadline to submit a Claim Form online is June 4, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than June 4, 2026.
Please do NOT submit your Claim Form to the Court or the Court Clerk’s Office.
